THE PINKERTON PROMISE MONEY BACK GUARANTEE – TERMS AND CONDITIONS
To Submit a Refund Submission:
1. To participate in The Pinkerton Promise Money Back Guarantee (the “Offer”), purchase one (1) pouch of Red Man Chewing Tobacco and/or America's Best Chew (the “Product”) on or after January 1, 2022. If you do not feel that your pouch of Red Man Chewing Tobacco and/or America's Best Chew lives up to the Red Man standard of freshness, send the original itemized store-identified dated cash register receipt with the purchase price circled (the “Receipt”) and the original The Pinkerton Promise Money Back Guarantee Offer Form (the “Form”), along with the UPC on the Red Man Chewing Tobacco and/or America's Best Chew pouch to the address below. The Form may be obtained directly from AmericasBestChew.com (the “Website”) available on or after January 1, 2022 or by contacting Pinkerton Tobacco Co. L.P. at 270-685-8777 to have one mailed to you. Your itemized purchase price indicated on your receipt [not to exceed two times the average cost of one (1) pouch of Red Man Chewing Tobacco and/or America's Best Chew] will be refunded, in the form of a check. If the purchase price indicated on your Receipt exceeds two times the average cost of one (1) pouch of Red Man Chewing Tobacco and/or America's Best Chew, as determined by the average pouch cost in the state purchased as defined by AC Nielsen syndicated data, refund amount will default to the average cost of one (1) pouch of Red Man Chewing Tobacco and/or America's Best Chew as defined by AC Nielsen syndicated data. Refunds will be made for exact Product purchase price (for those that provide a Receipt), regardless of sales tax and any coupons used, if applicable. If you do not have the original itemized store-identified dated cash register Receipt, only send the UPC on the Red Man Chewing Tobacco pouch and/or America's Best Chew, along with the completed original Form to the address below. For submissions submitted without the original itemized store-identified dated cash register Receipt, refund amount will be determined by the average pouch cost in the state purchased as defined by AC Nielsen syndicated data. If receipt is illegible or does not have the purchase price clearly circled, then the refund amount will be determined by the average pouch cost in the state purchase as determined by AC Nielsen syndicated data. All Forms not printed from the Website must accompany a photocopy of your valid U.S. driver’s license/government issued photo ID along with the Form.
2. On or after January 1, 2022, send The Pinkerton Promise Money Back Guarantee refund submission (the “Refund Submission”) with the completed Form obtained online at the Website or through the phone number listed above (along with a photocopy of your driver’s license), including your valid name, U.S. street address, e-mail address, phone number, reason for dissatisfaction, date of purchase, 6-digit code and the UPC on the Red Man Chewing Tobacco pouch and/or America's Best Chew and, if you have it available, the original store-identified dated cash register Receipt (dated on or after January 1, 2022) with the Red Man Chewing Tobacco and/or America's Best Chew purchase circled.

All Refund Submissions must be mailed in a regular letter-style envelope with sufficient postage.
3. Comply with all other terms and conditions set forth below.
LIMIT ONE REFUND SUBMISSION PER HOUSEHOLD ADDRESS. Duplicate or photocopied Refund Submissions will not be honored or acknowledged. Offer valid only in the 50 U.S. or D.C. (Void in Nebraska), must be a legal resident of the 50 U.S. or D.C., 21 years of age or older. Purchase one (1) pouch of Red Man Chewing Tobacco and/or America's Best Chew on or after January 1, 2022. Product purchased before that date are not eligible for the Offer. Purchase date is determined by date printed on Receipt or as indicated on the Form. Refund Submissions from Post Office Boxes, commercial addresses, containing invalid, undeliverable or non-U.S. mailing addresses, incomplete or illegible or any Refund Submissions deemed invalid, based on these Terms & Conditions will be rejected and will not be honored, acknowledged or returned. Pinkerton Tobacco Co. L.P. (“Sponsor”) is not responsible for printing errors or for lost, late, mutilated, misdirected, non-delivered or postage due mail. Refund Submissions must include all components listed in Section 2 above. Refund Submission rights cannot be assigned or transferred and the Offer is void in Nebraska and where taxed, restricted or prohibited by law. Keep copies of all materials submitted because Refund Submissions become property of Sponsor and will not be returned. Fraudulent Refund Submissions and/or use of multiple addresses to obtain multiple Refund Submissions could result in federal prosecution under mail fraud statutes (Title 18, USC Sections 1341 & 1342). Sponsor reserves the right to substantiate Refund Submissions and request additional identification and/or documentation. Refunds will be mailed within six (6) to eight (8) weeks from the date of receipt of valid Refund Submission. A third-party rebate fulfillment company processes Refund Submissions. Only actual purchasers of the Product may participate in the Offer. Offer not valid for groups, clubs or organizations, employees of Sponsor, its respective parents, subsidiaries, divisions, affiliates, supplier, distributors, agencies, or the fulfillment company or their respective suppliers and/or distributors, and their respective employees. No groups, clubs or organizations may reproduce or distribute the Form and this Offer may not be published in any refunding magazine, website, or elsewhere without Sponsor’s written permission. If any part of these Terms and Conditions are deemed to be invalid or otherwise unenforceable or illegal, the balance of the Terms and Conditions shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein.
